  • NY N047891 (January 15, 2009)
    • Women’s coat and woven scarf from Dominican Republic. The coat is made from 80% wool and 20% nylon woven fabric shell with a woven 100% polyester lining. The contrasting color woven scarf is made of 100% acrylic and will be swift tacked to each coat.
    • Classificaiton of the coat and scarf set is 6202.11.0010; the general (not CAFTA-DR preference) rate of duty is 41¢/kg + 16.3%.
    • The manufacturing operations are as follows:
      • The nonoriginating fabric, for the coat, is composed of 80% wool and 20% nylon, classified as 5111.30.9000.
      • The nonoriginating fabric, for the coat, is cut and assembled into the finished garment in the Dominican Republic.
      • The nonoriginating scarves are manufactured in China and are imported into Dominican Republic. The scarves are swift tacked to each coat.
    • On February 21, 2008, the Committee for the Implementation added this wool/nylon fabric to the CAFTA-DR short suply list, therefore the garment described may qualify for DR-CAFTA preferential treatment. However, since the coat and scarf are considered a set, the set must also meet the requirement that each of the goods in the set is an originating good, or the total value of the nonoriginating goods in the set does not exceed 10 percent of the adjusted value of the set. The importer Herman Kay statesthe value of the non-originating scarf is 8 percent of the value of the coat and scarf set, therefore the garment does qualify for DR-CAFTA preferential treatment and will be duty-free.
  • NY N027695 (June 4, 2008)
    • Men’s sweater of 100% wool, knit fabric that measures 7 stitches per 2 centimeters counted in the horizontal direction. The sweater has a rib knit stand-up collar, a full front opening with a zipper closure, long sleeves with rib knit cuffs, side seam pockets below the waist, and a rib knit bottom.
    • Classification is 6110.11.0015; rate of duty is 16%.
  • NY N024939 (March 25, 2008)
    • Four-ply twisted staple fiber yarn of 50% wool, 50% milk (casein, which according to Note 1(b) to Chapter 54, HTSUS, is an artificial fiber). Due to the fact that the yarn is to be constructed of a 50/50 blend of fibers, it is classified using HTSUS Section XI Note 2(A). The yarn will be classified as if it consisted wholly of that one textile material which is covered by the heading which occurs last in numerical order among those which equally merit consideration. Wool yarn is classified in Chapter 51, while artificial staple fiber yarn is classified in Chapter 55; thus, this yarn will be classified in Chapter 55.
    • Classificaiton is 5510.20.0000; rate of duty is 10.2%.
    • Please note that even a slight change in the fiber content may result in a change of classification.
